About

Disclaimer

Yes, tragically, this blog has to come with some boilerplate. First and foremost, the opinions here are either my own personal views or posed for the sake discussion. None of this content is necessarily endorsed by any employer, client, or entity with whom I am professionally affiliated.

Second, this is a blog, not an attorney-client communication. That means three things:
1. I am not your lawyer and this blog offers no legal advice for your specific legal needs. "I read a hypothetical online..." does not hold up in court.
2. Because I am not your lawyer, your comments are neither privileged nor confidential. Don't say anything stupid.
3. I am almost definitely not going to become your lawyer. This is not an attorney advertisement.

Commercial Use

Commercial does not mean "for profit". For the sake of clarity, commercial use for the purpose of this blog content is defined as use in commerce, including sale of copies, charging for access, posting within a paywalled site or service, or use in any publication paying royalties or other remuneration. Reprinting posts without commentary in a newsletter or other publication under the branding of any organization, whether electronically or in print, and whether for free or for charge, is also deemed a commercial use.

This non-commercial use requirement does not mean that I will not allow commercial use or even that you must pay for it. However, you must contact me in advance and obtain permission. Use the comment box below or email me: maustin.esq [at] gmail.com.

Comment Policy

With regard to comments, by posting here, you are granting this blog a non-exclusive right of public display on this domain and CC-BY-NC rights to me and to other readers of this blog. Otherwise, you retain copyright to your comments and are free to exercise it as you see fit.

While spirited disagreement and debate should be welcomed in any intellectual pursuit, trolling and flamewars will not be tolerated. Comments may be removed if circumstances warrant.

Regarding References

Finding the right balance between brevity and authority is an ongoing journey. I aim to provide citations somewhere between your typical blog and a formal academic publication. Although I experimented with going full-bore law review, the posts became unbearably long and terribly inconvenient to write.

I point readers to Wikipedia for many general concepts and explanations. This is not an endorsement of the content on those pages. In many cases, particularly in the legal field, Wikipedia's information is incomplete or not entirely correct and is offered only for the convenience of introductory background.

Citations to law and cases will generally not be hyperlinked. A general link to the United States Code at Cornell's Legal Information Institute is provided at the top of the page. Caselaw can be retrieved via Google search, the relevant court website, or your local law library.

Scholarly publications will be linked and cited with a DOI wherever feasible to fend off link rot.

Quotations and other references to material on other websites are reliable as of the posting date. Since you are using the Internet to view this, you know that content on those pages may change without warning.  Such is life.  I have no relationship with any commercial product or service mentioned on this site, or on any site referring back to me, unless otherwise noted.
